These policies are designed to protect the rights and responsibilities of both the Company and the Client while ensuring compliance with applicable local, state, federal, and international laws.
This Agreement also governs the services rendered by Arcana Astrology, a Vendor operating within Le Bijou Holistic Spa, and ensures the mutual protection of both entities from liability. By engaging with Arcana Astrology services, the Client further agrees to be bound by the policies outlined on the vendor’s website:

1.2 Eligibility and Legal Capacity
To access services, Clients must:

By agreeing to these Terms, Clients affirm that they meet these eligibility requirements. If services are booked for minors, the guardian assumes full responsibility for compliance with these Terms.
1.3 Definition of Key Terms
For clarity, the following terms are defined:
· “Client”: Any individual or entity accessing or using services provided by the Company or Vendor.
· “Company”: Refers to Le Bijou Holistic Spa and its affiliates.
· “Vendor”: Refers to Arcana Astrology, an independent service provider operating within Le Bijou Holistic Spa.
· “Services”: Any treatment, consultation, or product offered by the Company or Vendor.
· “Agreement”: This document, including any updates or amendments to these Terms.
1.4 Service Availability, Restrictions, and Modifications Clause
· All services are subject to availability and may be modified, restricted, or discontinued at the Company’s sole discretion.
· The Company and Vendor reserve the right to deny services to individuals who violate these Terms, provide false information, or exhibit inappropriate behavior.

1.5 Price Adjustments, Notifications, and Client Consent Clause
· The Company reserves the right to adjust prices at any time without prior notice.

· Clients continuing to use services after price adjustments implicitly agree to the updated pricing.
1.6 Right to Refuse Service or Business Clause
The Company and Vendor reserve the right to refuse service to any individual for reasons including, but not limited to:

Upon termination, Clients may be banned from future bookings and will forfeit any deposits or credits, subject to the Refund Policy.
1.8 Restricted Items, Activities, and Prohibited Behavior Policy Clause
Clients are prohibited from:
· Bringing weapons, illegal substances, or hazardous materials onto the premises.
· Engaging in harassment, theft, vandalism, or other disruptive behavior.
Violations will result in immediate removal from the premises, termination of services, and potential legal action.
1.9 Governing Law, Jurisdiction, and Arbitration Clause
· This Agreement is governed by the laws of the State of California.
· Disputes will be resolved through binding arbitration in San Diego County, California, in accordance with the rules of the American Arbitration Association.
· Both the Client and the Company waive the right to file lawsuits or participate in class actions.
1.10 Severability and Non-Waiver Clause
· If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
· Failure by the Company or Vendor to enforce any provision does not constitute a waiver of its rights.

· By accessing or using services, Clients agree to these Terms and acknowledge that they have reviewed and understood this Agreement.

1.12 Forceful Ejection, Removal, and Permanent Ban Policy
The Company reserves the right to:
· Immediately remove individuals from the premises for violations of these Terms or safety concerns.
· Permanently ban individuals who threaten the well-being of staff, Clients, or Vendors.
1.13 Client Representation, Truthfulness, and Fraudulent Statements Clause
· Clients are required to provide accurate and truthful information when booking services, completing forms, or during consultations.
· Misrepresentation or falsification of information may result in termination of services, forfeiture of payments, and legal action.
1.14 Acknowledgment of Terms and Policy Compliance Clause
· Clients affirm that they have read, understood, and agree to these Terms.
· Failure to comply may result in denial of services, removal from premises, or legal action.
1.15 Assumption of Inherent Risks and Client Responsibility Clause
· By engaging in services, Clients acknowledge the inherent risks associated with treatments, including physical or emotional effects.
· Clients are solely responsible for disclosing all relevant health, legal, or personal information necessary for service suitability.
1.16 Compliance with Local, State, Federal, and International Laws Clause
· Clients must adhere to all applicable laws when using the Company’s services.
· The Company and Vendor are not liable for any Client actions that violate legal or regulatory standards.
1.17 Vendor, Staff, and Partner Rights Protection Clause
· The Company and Vendor are committed to protecting the rights, safety, and dignity of all staff, vendors, and business partners.
· Harassment, abuse, or inappropriate behavior directed toward any individual associated with the Company or Vendor will result in immediate action, including permanent bans and legal recourse.
1.18 Exclusive Enforcement Clause for Policy Disputes
· The Company and Vendor retain exclusive rights to interpret and enforce these Terms.
· All disputes or challenges to these Terms will be resolved solely at the discretion of the Company or Vendor and in accordance with Section 1.9 (Governing Law, Jurisdiction, and Arbitration).
2.1 Booking, Deposit, and Confirmation Policy Clause
· Deposit Requirements:
All bookings require a non-refundable deposit. The deposit amount varies by service and will be communicated at the time of booking. This deposit secures the Client's appointment and demonstrates their commitment to the scheduled service.
· Booking Confirmation:
A booking is not deemed confirmed until the required deposit is received in full, the Client has acknowledged these Terms of Service, and the Company has issued a written or electronic confirmation notice.
· Arcana Astrology Bookings:
Clients booking services rendered by Arcana Astrology within Le Bijou Holistic Spa are also bound by the Vendor’s terms and conditions, available at:

Neither Le Bijou Holistic Spa nor Arcana Astrology is responsible for incomplete bookings, missed appointments, or scheduling errors caused by inaccurate or incomplete information provided by the Client.
2.2 Refunds and Prepaid Services Policy Clause
· Refund Eligibility:
Refunds are only provided for cancellations initiated by the Company or Vendor or in cases of extenuating circumstances, as determined at the sole discretion of management.
· Prepaid Service Conditions:
Prepaid services, including packages and credits, must be used within the specified validity period. Unused services are non-refundable, non-transferable, and cannot be extended unless required by applicable law.
· Administrative Fees:
Refunds for prepaid services may be subject to deductions for administrative and processing fees, including any non-recoverable transaction costs.
· Vendor-Specific Refunds:
Refund requests for services provided by Arcana Astrology must adhere to the Vendor’s refund policy outlined on its website.
2.3 Payment Terms, Accepted Methods, and Currency Policy
· Accepted Payment Methods:
Payments may be made using credit cards, debit cards, cash, or any other methods explicitly approved by the Company or Vendor.
· Currency:
All payments must be made in U.S. dollars unless a specific alternative arrangement is agreed upon in writing.
· Payment Accuracy:
Clients are responsible for ensuring that all payment information provided is accurate, complete, and up to date at the time of booking or purchase.
· Third-Party Payment Vendors:
Payments processed through third-party vendors (e.g., payment gateways) are subject to their terms and conditions. The Company and Vendor are not liable for issues arising from third-party payment processing errors, delays, or disputes.
2.4 Refund, Dispute, and Chargeback Policy Clause
· Dispute Resolution:
Clients must attempt to resolve disputes directly with the Company or Vendor before initiating chargebacks. Disputes must be submitted in writing within 30 days of the service date.
· Chargeback Consequences:
Clients initiating chargebacks without prior communication and resolution attempts may:
·Forfeit all deposits, credits, and eligibility for future bookings.
·Be subject to legal and financial penalties, including reimbursement of chargeback fees, administrative costs, and attorney fees.
· Vendor-Specific Chargebacks:
Chargebacks related to Arcana Astrology services must be directed to the Vendor. Fraudulent chargebacks involving Arcana Astrology will result in permanent bans and potential legal action.
2.5 Gift Card, Credit, and Prepaid Services Limitations Clause
· Non-Transferability:
Gift cards, service credits, and prepaid services are non-transferable, non-refundable, and cannot be redeemed for cash unless explicitly required by law.
· Expiration:
Gift cards and credits must be used within their stated validity periods. The Company and Vendor are not responsible for reminders or notifications regarding expiration dates.
2.6 Membership Auto-Renewal, Freezes, and Cancellation Terms
· Auto-Renewal:
Memberships automatically renew on their specified renewal dates unless canceled by the Client at least 30 days in advance.
· Freezes and Extensions:
Memberships may be frozen for a maximum of 90 days per calendar year, subject to prior written approval by the Company.
· Early Termination:
Early termination of a membership may result in cancellation fees or forfeiture of benefits, as outlined in the Membership Agreement.
2.7 Advance Booking, Priority Scheduling, and Cancellations Clause
· Priority Scheduling:
Advance bookings may grant Clients priority access to services, as determined by the Company’s policies.
· Cancellation Deadlines:
Advance bookings must be canceled at least 24 hours before the scheduled appointment. Failure to meet this deadline will result in forfeiture of the deposit and may incur additional cancellation fees.
2.8 Fraudulent Booking, Misrepresentation, and Penalty Policy Clause
· Fraudulent Activity:
Fraudulent bookings, use of false identities, or misrepresentation of information is strictly prohibited.
· Penalties for Misconduct:
Clients engaging in such behavior may face:
· Immediate cancellation of all bookings.
·Forfeiture of all deposits and payments.
·Permanent bans from services and potential legal action.
2.9 Appeals for Denied Refunds and Final Decisions Clause
· Appeals Process:
Clients may appeal refund denials by submitting a written request with supporting evidence within 14 days of the denial.

All appeal decisions made by the Company or Vendor are final, binding, and non-negotiable.
2.10 Late Payment, Interest Fees, and Penalty Policy Clause

2.12 Unused or Expired Service Credits and Gift Cards Policy Clause
· Expiration Policy:
Service credits and gift cards must be used within their specified validity periods. Extensions are granted only in exceptional cases and at the sole discretion of management.
· No Refunds:
Expired credits and gift cards will not be refunded or redeemed for cash unless required by law.
2.13 Non-Refundability of Custom Add-Ons and Customization Requests Clause

Customizations, add-ons, or special requests to services are non-refundable under any circumstances.

Clients must direct all Arcana Astrology-related disputes to the Vendor via official communication channels.

Clients agree to indemnify and hold harmless both Le Bijou Holistic Spa and Arcana Astrology from any claims, losses, or damages resulting from services rendered.
3.1 Liability Waiver for Personal Belongings and Losses Clause
· Client Responsibility:
Clients are solely responsible for securing their personal belongings while on the premises.
· No Liability:
The Company and its Vendors, including Arcana Astrology, are not liable for lost, stolen, or damaged items, including but not limited to jewelry, electronics, clothing, or other personal property.
· Precautionary Measures:
Clients are strongly encouraged to leave valuables at home or use designated storage areas, where available.
3.2 Comprehensive Code of Conduct for Clients Policy
· Expectations of Behavior:
Clients are required to act respectfully and courteously toward all staff, Vendors, and other clients while on the premises.
· Consequences for Misconduct:
Behavior deemed disrespectful, disruptive, or harmful to others will result in immediate action, including service termination, removal from the premises, and permanent banning.
· Protection of Vendors:
Arcana Astrology staff and services are equally protected under this policy, and inappropriate conduct directed toward Vendor staff will result in similar consequences.
3.3 Zero-Tolerance Policy for Prohibited Conduct and Behavior Clause
· Prohibited Conduct:
The Company enforces a zero-tolerance policy for the following:
·Verbal or physical harassment of staff, Vendors, or other clients.
·Aggressive, violent, or threatening behavior.
·Vandalism, theft, or intentional damage to Company or Vendor property.
· Enforcement:
Violators will face immediate removal, permanent bans, and potential legal or law enforcement action.
3.4 Sexual Harassment, Bullying, and Inappropriate Conduct Policy
· Prohibited Actions:
Any form of sexual harassment, bullying, or inappropriate conduct, including unwelcome advances, suggestive comments, physical contact, or other behaviors that make staff, Vendors, or clients uncomfortable, is strictly prohibited.
· Consequences:
Violators will be subject to immediate removal, permanent banning, and legal consequences.
· Vendor Protection:
Harassment or inappropriate conduct toward Arcana Astrology staff or during Vendor-provided services will be treated with equal severity.
3.5 Anti-Discrimination, Diversity, and Inclusion Policy Clause
· Commitment to Inclusion:
The Company and its Vendors are committed to maintaining an inclusive environment for clients of all genders, races, ethnicities, sexual orientations, and abilities.
· Prohibited Discrimination:
Discriminatory language, actions, or behaviors will not be tolerated and will result in immediate removal and potential banning from future services.
3.6 Client Waiver for Non-Compliance with Aftercare Instructions Clause
· Client Obligation:
Clients must adhere to all aftercare instructions provided by the Company or Vendors to ensure safe and effective results from services.
· No Liability:
The Company and Vendors are not liable for any adverse effects resulting from the Client's failure to follow aftercare instructions.
3.7 Forceful Removal for Disruptive or Dangerous Behavior Clause
· Authority to Act:
The Company and Vendors reserve the right to remove any individual from the premises for behavior that poses a threat to the safety, well-being, or operations of the business.
· Documentation:
All incidents involving forceful removal will be documented in an incident report.
· Permanent Ban:
Removed individuals may be permanently banned from returning and may face legal or financial consequences.
3.8 Restricted Access for Non-Clients and Unauthorized Guests Policy
· Premises Access:
Only individuals with confirmed appointments or explicit business purposes are permitted on the premises.
· Guest Restrictions:
Unauthorized guests, including friends or family members of clients, may be denied entry unless explicitly approved by management.
3.9 Substance Abuse, Intoxication, and Contraband Policy Clause
· Prohibited Conduct:
Clients under the influence of drugs or alcohol are prohibited from receiving services and may be asked to leave immediately.
· Illegal Substances:
Possession or use of illegal substances or contraband on the premises will result in immediate removal and may be reported to law enforcement.

Clients must adhere to any specific dress code or grooming requirements as dictated by the nature of the service being provided.
· Service Denial:
Failure to comply with these standards may result in rescheduling or denial of services.
3.11 Safety and Equipment Damage Responsibility Clause

Clients must follow all safety instructions provided by staff or Vendors while using equipment or receiving services.
· Liability for Damages:
Clients will be held financially responsible for any intentional or negligent damage caused to Company or Vendor equipment or property.
3.12 Conflict Resolution and On-Site Incident Reporting Clause
· Encouragement to Report:
Clients are encouraged to report conflicts, concerns, or incidents to management or Vendor representatives immediately.
· Incident Documentation:
The Company and Vendors will document all reported incidents and address them in a timely and professional manner.
3.13 Prohibition on Unauthorized Recording or Photography Policy
· No Recording Without Consent:
Recording or photographing staff, clients, Vendors, or Company property without prior written consent is strictly prohibited.
· Enforcement:
Violators may be removed from the premises, banned from future services, and subject to legal action.
3.14 Mandatory Medical and Skin Condition Disclosure Policy Clause
· Client Responsibility:
Clients are required to disclose all relevant medical conditions, allergies, or skin sensitivities that may affect the suitability or outcome of services.
· Waiver of Liability:
Failure to disclose such information releases the Company and Vendors from any liability for adverse effects or outcomes.
3.15 Acknowledgment of Compliance with Spa Rules and Guidelines Clause
· Agreement to Comply:
By booking or attending an appointment, Clients acknowledge that they have read, understood, and agreed to comply with all rules and guidelines set forth by the Company and Vendors.
3.16 Waiver of Claims for Services with Known Risks Clause
· Acknowledgment of Risks:
Certain services may involve inherent risks, such as allergic reactions or other side effects.
· Liability Waiver:
By proceeding with any service, Clients acknowledge these risks and waive any claims against the Company or Vendors for disclosed or inherent risks.
4.1 Late Arrival Policy with Fees and Service Adjustments Clause
· Service Adjustments for Late Arrivals:
Clients arriving late to their scheduled appointment may experience shortened service times to accommodate other scheduled appointments. The Company is not obligated to extend service times or reschedule missed portions of appointments due to late arrivals.
· Cancellation for Late Arrivals:
Clients arriving more than 15 minutes past their scheduled appointment time may have their appointment canceled, and their deposit forfeited.
· Rescheduling Fees:
Late arrivals requiring rescheduling may incur additional fees as outlined in the Company’s booking policy. These fees are non-refundable and must be paid in full prior to confirming the new appointment.
· Vendor Services:
For appointments booked through Arcana Astrology, similar policies apply, and the Vendor reserves the right to refuse service or reschedule late arrivals.
4.2 Cancellation, Rescheduling, and Refund Restrictions Clause
· Cancellation Notice Requirements:
Clients must provide at least 24 hours' notice to cancel or reschedule an appointment. Cancellations or rescheduling requests made with less than 24 hours' notice will result in forfeiture of deposits.
· Refund Restrictions:
Refunds for canceled services are subject to the Refund Policy and may include deductions for administrative and processing fees. Refunds are not available for cancellations made within the 24-hour window, except in cases of extenuating circumstances at the Company’s discretion.
· Arcana Astrology Services:
Refunds and rescheduling requests for services provided by Arcana Astrology are governed by the Vendor’s specific refund and cancellation policies, as outlined at Arcana Astrology Refund Policy.
4.3 Membership Freeze, Cancellation, and Refund Limitation Clause
· Freezing Memberships:
Memberships may be frozen for a maximum of 90 days per calendar year with prior written notice to the Company. Requests must be submitted at least 30 days before the freeze start date.
· Early Cancellation:
Clients canceling memberships early may be charged an early termination fee as specified in the Membership Agreement. Unused services within the membership term are non-refundable but may be converted to credits, at the Company’s discretion.
· Refund Limitations:
Refunds for canceled memberships will be issued only for unused services, less any administrative or processing fees. Refunds are not available for discounted memberships or promotional packages.
4.4 No-Show and Abandonment Penalty Policy Clause
· Penalty for No-Shows:
Failure to attend an appointment without prior cancellation or rescheduling will result in the forfeiture of the deposit or the full payment of the service cost.
· Repeat Offenders:
Clients with two or more no-show incidents may be restricted from booking future appointments or required to pay in full at the time of booking.
· Vendor No-Show Policies:
For services booked with Arcana Astrology, no-shows are subject to the Vendor’s specific penalties and restrictions.
4.5 Operational Interruptions or Service Loss Clause
· Unforeseen Interruptions:
In the event of an operational interruption, such as a power outage, staff absence, or emergency closure, the Company will make reasonable efforts to notify affected Clients as soon as possible.
· Rescheduling Options:
Clients affected by operational interruptions may be rescheduled at no additional cost or offered credits for future services.
· No Refunds for Uncontrollable Events:
Refunds will not be issued for interruptions caused by events outside the Company’s control, including but not limited to natural disasters, power failures, or vendor-specific issues.
· Vendor-Specific Interruptions:
For Arcana Astrology services, operational interruptions are managed according to the Vendor’s policies, and the Company is not liable for disruptions caused by the Vendor.
4.6 Apprenticeship, Training, and Reduced-Rate Services Policy Clause
· Training Services Disclaimer:
Services performed by apprentices or staff undergoing training may be offered at a reduced rate. By booking these services, Clients acknowledge that the quality may differ from that of fully trained professionals.
· No Refunds for Training Services:
Refunds or adjustments will not be issued for dissatisfaction with services provided under training or apprenticeship terms.
· Waiver of Liability:
Clients waive the right to claim compensation for perceived deficiencies in reduced-rate services.
4.7 Waitlist Management, Priority Scheduling, and Cancellation Policy Clause
· Waitlist Procedure:
Clients on the waitlist will be contacted on a first-come, first-served basis when availability arises. Failure to confirm availability within the specified time frame may result in forfeiture of the waitlist opportunity.
· Priority Scheduling:
Membership holders or clients with pre-purchased packages may receive priority scheduling over waitlist clients.
· Waitlist Cancellations:
Clients canceling confirmed waitlist appointments are subject to the same cancellation policies as regularly scheduled appointments.
4.8 Emergency Client-Initiated Cancellation and Refund Policy Clause
· Emergency Situations:
Clients who need to cancel due to emergencies such as illness, accidents, or other unavoidable circumstances must notify the Company as soon as possible.

For services provided by Arcana Astrology, double-booking resolutions will be handled in accordance with the Vendor’s policies.
4.10 Vendor-Specific Appointment Management Clause

1.) All clients are expected to conduct themselves respectfully, and all services and duties from staff shall be performed professionally. Le Bijou has a zero tolerance policy for any form of sexual harassment, innuendos, advancements, suggestive behavior or language, or intimidation and any attempt will result in immediate police involvement and a full charge of services.
2.) Non-members are required to leave a 50% deposit which is refunded only if canceled 24 hours or more before your appointment. You will be receiving text and email reminders both 48 hours and 2 hours before your appointment, please confirm your appointment through the prompts. Please be 5 minutes early to your appointment so you aren't late, as late clients may be marked a no-show and will not refunded their deposit. Additionally, no-show clients will be required to pay in full for future appointments. If we are able to accommodate your later arrival, your service may be cut short to be on time for the next client.
3.) All clients must arrive to their appointment clean and showered for the safety and sanitation of our staff and salon, especially for services involving private areas.
4.) Le Bijou and our providers make no claims to heal, treat, or cure any illness. Please talk to your doctor about all medical concerns.
